Simone Sgarro (hereinafter referred to as the “Controller” or “Simone Sgarro”), in his capacity as Data Controller, informs you pursuant to Article 13 of EU Regulation No. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following ways and for the following purposes:

1. Purpose of the Processing

The Controller processes identifying data and usage data generated during the interaction of the data subject with the Controller’s website (the “Website”), available at www.sgarrodesign.com
— hereinafter “personal data” or simply “Data”.

The Website may also track certain information related to the User’s network (e.g., IP address).

2. Purposes and Legal Basis of the Processing

Your personal data are processed for the following purposes:

a) to respond to information requests and contact the user through the email address provided via the contact form;

b) to collect statistics and metrics aimed at ensuring the proper functioning of the Website;

c) to exercise the Controller’s rights (for example, the right of legal defense).

The legal bases for the above purposes are as follows:

Regarding purpose (a), the processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract;

Regarding purposes (b) and (c), the legal basis is the legitimate interest of the Controller, namely to monitor the correct functioning of the Website and to exercise the Controller’s rights such as legal defense.

Providing data for the above purposes is optional. Failure to provide such Data will make it impossible to properly interact with the Website.

3. Data Retention Period

Personal data will be retained for as long as necessary to fulfill the purposes set out in this notice.
The Controller will retain a copy of correspondence of legal and commercial relevance for ten years, as required by the Italian Civil Code.
User data may also be retained for as long as necessary to ensure legal defense or to pursue any misuse of this Website.

4. Data Disclosure

User data will not be disseminated but may be made accessible, where necessary for the provision of services or by law:

Personal data are stored on servers located within the European Union, managed by third-party companies duly appointed as Data Processors.

The Controller may transfer certain categories of User Data to countries outside the European Union. Such Data will only be transferred to countries deemed adequate by the European Commission or to companies that provide sufficient safeguards in accordance with Articles 44–50 of the GDPR.

6. Rights of the Data Subject

In relation to the data processing described herein, you may exercise the rights provided under the GDPR (Articles 15–22), including:

a. to receive confirmation as to whether or not personal data concerning you exist and to access their content (right of access);
b. to update, modify and/or correct such data (right of rectification);
c. to request the deletion or restriction of processing of data processed unlawfully, including data whose storage is unnecessary for the purposes for which they were collected or otherwise processed (right to erasure and right to restriction);
d. to object to the processing (right to object);
e. to lodge a complaint with the supervisory authority (the Italian Data Protection Authority – www.garanteprivacy.it
) in case of a breach of data protection law;
f. to receive an electronic copy of your personal data, where such data have been provided under a contract, and to request that such data be transmitted to another data controller (right to data portability).
